TRIBUNNEWS.COM, JAKARTA – The Corruption Eradication Commission (KPK) appoints the Governor of Papua Luke Enembe as a suspect in cases of alleged bribery and gratuities.

However KPK stated that he could stop the alleged bribery and gratification cases that ensnared him Luke Enembe on the terms of the parties Luke Enembe must prove the source of billions of rupiah into suspicious transactions based on the findings of the Financial Transaction Reports and Analysis Center (PPATK).

According to the General Chairperson of the KNPI DPP, Haris Pertama, the statement KPK which could have revoked the suspect status Luke Enembe tantamount to showing that the anti-corruption agency only refers to the PPATK report.

“We must remember that the PPATK report is not evidence that can immediately be declared as a criminal act of corruption, but only as an initial indication of the extent to which there are irregularities in financial transactions,” Haris said in his statement, Friday (23/9/2022).

According to him, the irregularities of financial transactions as reported by the PPATK need to be proven first by the KPK regarding indications of corruption committed by Lukas Enembe.

If the unreasonable transaction is not the result of corruption, then the transaction, even though the value is fantastic, must be declared fair because it does not originate from state money or from abuse of authority.

According to Haris, Lukas Enembe is only required to prove his transaction if he has become a suspect in money laundering offenses, which money laundering offenses can only be carried out if Lukas Enembe has been proven guilty based on permanent legal force.

“Lukas Enembe is not obliged to prove the source of the money because the burden of proof is not in the hands of Lukas Enembe but in the hands of the investigator. So it would be a big mistake if the KPK asked Luke Enembe to prove it,” he said.
